Terms of Service

1. About these Terms
These Terms of Service ("Terms") govern your access to and use of the mobile applications, websites, and related products and services provided by Gotta LLC ("Gotta," "we," "us," or "our") (collectively, the "Services"). Gotta is a social discovery service that lets people save, organize, discover, recommend, request, and share places, media, products, activities, and other things.
By creating an account, accessing, or using the Services, you agree to these Terms and our Community Guidelines. Our Privacy Policy explains how we handle personal information. If you do not agree, do not use the Services.
2. Who may use Gotta
You must be at least 16 years old and legally able to enter into these Terms. If the law where you live requires permission from a parent or legal guardian, you may use Gotta only with that permission. You may not use the Services if we previously disabled your account for violating our rules, unless we give you written permission to return.
If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. Your account
You agree to provide accurate account information, keep it current, protect your credentials, and promptly tell us if you believe your account has been compromised. You are responsible for activity on your account to the extent permitted by law. You may not sell, transfer, or allow another person to misuse your account.
Some features or content may be available only to registered users, approved followers, or users who meet other reasonable eligibility requirements.
4. The Services
We grant you a personal, limited, revocable, non-exclusive, non-transferable license to use the Services for their intended purposes and in accordance with these Terms. Gotta and its licensors retain all rights in the Services not expressly granted to you.
We may add, change, test, limit, suspend, or discontinue features or parts of the Services. Features identified as beta, preview, or experimental may be incomplete, change without notice, or stop working. We do not promise that any particular feature or content will always be available.
5. Your content
You keep ownership
You retain ownership of posts, comments, photos, lists, profile information, feedback, and other content you submit to the Services ("Your Content").
Permission to operate Gotta
When you submit Your Content, you grant Gotta a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to host, store, reproduce, format, adapt, publish, display, distribute, analyze, moderate, and otherwise use Your Content as reasonably necessary to operate, provide, secure, improve, and promote the Services.
This permission lets us perform ordinary technical and operational activities such as resizing images, generating previews and search metadata, displaying content to the audiences you select, delivering shared content, evaluating content for safety, and displaying or featuring public content when describing or promoting Gotta, including on Gotta-owned channels. We will respect applicable profile and content visibility settings and will not use private content to promote Gotta.
This license generally ends when Your Content is deleted from our active systems. It may continue to the limited extent that content was previously copied or shared outside Gotta, remains in reasonable backup systems, must be preserved as moderation or safety evidence, or must be retained to comply with law. If you delete your account, your public profile and content are removed from public view and associated account data is deleted through our deletion process. References held by other users may instead show a generic deleted or unavailable state, or may disappear. Copies already captured by others or cached outside our control may remain. Your responsibilities
You represent that you have the rights and permissions needed to submit Your Content and allow us to use it as described in these Terms. Your Content must not violate law, these Terms, our Community Guidelines, or another person's rights.
6. Visibility and sharing
Depending on your settings and how you use a feature, Your Content may be visible to approved followers, other Gotta users, recipients you select, or the public. People who can see content may save, capture, copy, or share it outside Gotta. We cannot control what other people do with information they receive.
Review the audience and location information associated with content before posting. Do not share information that you do not want the applicable audience to see.
7. Acceptable use
You may not use the Services to:
- threaten, harass, bully, exploit, intimidate, or promote hatred or violence against a person or group;
- create, possess, solicit, share, or promote child sexual abuse material or the sexual exploitation or endangerment of minors;
- post or threaten to post nonconsensual intimate imagery, including digitally created or altered imagery;
- impersonate others, commit fraud, run scams, send spam, manipulate engagement, or mislead people in a materially harmful way;
- infringe intellectual property, privacy, publicity, confidentiality, or other legal rights;
- disclose another person's sensitive personal information without authorization;
- encourage serious wrongdoing or use Gotta for an unlawful purpose;
- introduce malicious code, probe security, interfere with the Services, scrape or automate access without permission, or bypass technical restrictions;
- evade a block, suspension, content restriction, or other enforcement action; or
- help another person do anything prohibited by these Terms or our Community Guidelines.
These examples are not exhaustive. Our Community Guidelines provide additional detail and are part of these Terms.
8. Moderation and enforcement
We may use automated systems, human review, user reports, and other reasonable methods to operate and protect Gotta. We may review, screen, restrict, remove, preserve, or disclose content, and may warn, limit, suspend, or terminate accounts, when we reasonably believe it is necessary to:
- operate, secure, or improve the Services;
- enforce these Terms or our Community Guidelines;
- investigate reports or prevent harm, fraud, or abuse;
- protect Gotta, our users, or other people; or
- comply with law or a valid legal request.
We are not required to monitor all content and cannot guarantee that objectionable content will never appear. A delay or failure to act does not waive our right to act later. Where appropriate, you may contact us if you believe we made a mistake.
9. Reports and urgent safety matters
You can report content or users and block other users using the tools available in the Services. For urgent child-safety matters or nonconsensual intimate imagery, follow the processes described in our Community Guidelines. We may preserve relevant information and report matters to appropriate authorities when required or reasonably necessary to protect someone from harm.
10. Recommendations and user content
Recommendations, requests, comments, lists, locations, and other user content reflect the views of their authors. Gotta does not endorse or guarantee their accuracy, quality, safety, legality, availability, or suitability. Use your own judgment and independently verify information before acting on it, especially information involving health, safety, travel, products, businesses, or physical locations.
11. Third-party services and content
The Services may display or link to information, maps, images, availability, products, media, businesses, and other material supplied by third parties. Third-party information may be incomplete, inaccurate, delayed, or unavailable. Gotta does not control third-party services, and your use of them may be governed by their own terms and privacy policies.
12. Paid features, advertising, and promotions
Gotta may offer paid features, subscriptions, trials, advertising, sponsored content, affiliate links, or other promotions. Any price, billing period, automatic-renewal terms, cancellation method, and other material purchase terms will be presented before you complete a purchase. Purchases made through an app marketplace may also be subject to that marketplace's payment and cancellation rules.
Sponsored or affiliate content may generate compensation for Gotta. We may add, change, or discontinue monetization features, subject to applicable law and any commitments presented at the time of purchase.
13. Intellectual property
The Services, including their software, design, branding, and Gotta-created content, are owned by Gotta or its licensors and are protected by intellectual-property laws. Except for the limited license above, these Terms do not give you ownership of the Services or permission to use Gotta's names, logos, or branding.
If you believe content on Gotta infringes your intellectual-property rights, email hello@joingotta.com with enough information for us to identify the work, locate the content, and contact you.
14. Feedback
If you send us ideas, suggestions, or other feedback, you allow us to use it without restriction or compensation to you. This does not transfer ownership of content that you post through ordinary social features.
15. Suspending or ending use
You may stop using Gotta at any time and may delete your account through the app, or by following our account deletion instructions if you cannot reach the app. Account deletion is irreversible. We may suspend or terminate access if you violate these Terms, create risk or legal exposure, repeatedly infringe others' rights, or if continuing to provide the Services is no longer commercially or technically practical.
Provisions that by their nature should survive termination will survive, including provisions concerning retained content, intellectual property, disclaimers, limitations of liability, and disputes.
16. Disclaimers
To the fullest extent permitted by law, the Services are provided "as is" and "as available." Gotta disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not warrant that content will be accurate, preserved, safe, or available at any particular time.
Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you. Nothing in these Terms excludes rights that cannot lawfully be excluded.
17. Limitation of liability
To the fullest extent permitted by law, Gotta and its personnel will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities, arising from or related to the Services.
To the fullest extent permitted by law, Gotta's total liability for claims arising from or related to the Services will not exceed the greater of the amount you paid Gotta for the Services during the 12 months before the claim or US$100. These limitations do not apply where prohibited by law or to liability that cannot lawfully be limited.
18. Mobile app marketplaces
If you download the app through Apple's App Store or another app marketplace, your use is also subject to that marketplace's applicable terms. For Apple devices, the app is licensed under Apple's Standard Licensed Application End User License Agreement unless a custom license is presented. The marketplace is not responsible for Gotta's content, support, or operation except as its terms expressly provide.
19. Changes to these Terms
We may update these Terms as the Services, our practices, or the law changes. We will post the revised Terms and update the effective date. If a change materially affects your rights, we will provide additional notice when reasonably required. Your continued use after updated Terms take effect means you accept them, to the extent permitted by law.
20. Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles. Except where applicable law requires otherwise, disputes arising from these Terms or the Services will be brought in the state or federal courts serving Richmond, Virginia, and you and Gotta consent to those courts' jurisdiction. Nothing in these Terms limits rights that cannot be waived under applicable law.
21. General terms
These Terms, the Community Guidelines, and any additional terms presented for a specific feature form the agreement between you and Gotta concerning the Services. If part of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our permission; we may transfer them as part of a merger, acquisition, financing, reorganization, or sale of all or part of our business, subject to applicable law.
